When I break it is juddering forward and back like its only gripping 2/3 of the disc then slipping for the other 3rd of the disc. The garage has just fitted new pads but it did same before do you think the discs need replacing? Also tracking wouldnt affect this at all would it?

Did they fit discs all round? Front and back?
If they did it could be excessive play in the wishbome bushes.

Warped discs would be my diagnosis from your description. GSF sell OEM quality discs for reasonable money.
