If I read the statement made by this company, which likens a remap to fitting a tow bar or a sound system, I would find another company. A tow bar or sound system will not affect your fueling, gearbox, clutch etc. and don't involve opening the ECU.
I wish you good luck getting somewhere with your claim but you must be realistic. Presumably you did some research on remaps and any search on here would get a lot of results about warranty issues.
I would like a remap and really fancy the one which the guy in Holland does but I won't be doing anything until the car is out of warranty and if I do get it done, I am going in with my eyes open to any potential problems which will be mine-not Audis.

There's one thing you should establish, and that is whether the ECU was damaged during the remapping process, or the remap was considered to have caused an issue elsewhere.

If the ECU was damaged in the process of opening it or mapping it, the responsibility is with the remapping company that performed the operation. It really is that simple. If we damaged an ECU we would take responsibility for the replacement. I believe Viezu to be a professional company so I would expect them to take responsibility if you could show they caused the damage. There are risks in opening a Tricore protected ECU when it is necessary. These risks should be shouldered by the remapper!

If the remap was being used as an excuse to get out of a warranty claim for other faults, technically, the warranty company should have to prove the fault was caused by the remap. I say 'technically' because we all know how insurers work - and warranty companies are insurers who usually find any excuse not to pay out.

In your case it sounds like the ECU needed replacing. This should only be necessary if it was physically damaged, so I think you should get a proper report from the company that replaced it stating why it was replaced. If it was physical damage to the board inside, you have a case with the remapping company. If it was only a software problem, it shouldn't have needed to be replaced, just re-flashed.

Your only problem now is that this is past history. Viezu might, quite reasonably, have expected you to go back with them to discuss the problem before the ECU was replace by a third party.
