View Full Version : Question Opinions on blame in accident

I wanted to get some advice on an accident that happened on my way home from work last night. I don’t want this to degrade into an argument as all the other forum posts I have found on this subject via google.

The scenario is I am on a roundabout going straight on. The car at the junction to my left pulls out to go straight over turn right I am not sure. He crosses my path and leaves insufficient time for me to stop. I collide with his rear drivers door and the scrape the rear quarter of his car as he had tried to avoid me. The damage is to my front nearside corner on the car.

Who is to blame?

He is, on a roundabout you give way to the right.
Was your exit clear? if not he may argue your where blocking roundabout. Also don't let insurance company settle knock for knock.
From those two pictures you can see he has driven across the front of you before you explain. I think its going to be a simple case unless he argues and argues.

My exit was clear and he had a clear line of sight of me.

I am thinking of using a third party company as I have done before. They will only take on cases they are sure they can win. At least that way they are fighting your corner for you.

He is at fault in my opinion, for the reason given above, he should give way to traffic from his right on a roundabout. He may try to claim that he was already on the roundabout and you entered at such a speed you couldn't stop, but if that were the case, there would be considerably more damage.
