Thought the a6 was pretty much all aluminium so there isn't any steel and if there were you would have thought they would mix them about like this as different metal expands and contract at different rates and eventually cause rubbing and corrosion.old Range Rover tailgates were bad for this.

Well worth taking Audi to a small claim court for the cost of a paint repair. They will cave in before it gets to court.

You can't do that, you have to take the supplying dealer to the small claims court, it is the dealer with whom you have a contract, not Audi. Of course, Audi may be keen to avoid that and step in to resolve the matter.

I had this issue with Fiat, when our 500 cut its way through the tailgate wiring loom after three and a half years - a common problem and £800 to fix. I asked our solicitor, who advised that I had to threaten to take the dealer from whom we bought the car to court. But before we got too far down that road, Fiat agreed to repair the car at their cost.

Surely it depends on what you are claiming.

If its a defective under the paint warranty provided by Audi then its Audi and this would extend longer than potentially the SOGA supports.

If its SOGA related then it would be the dealer.

Fair point. Time for a solicitor, perhaps, to advise us! However, I think that, after the SOGA becomes irrelevant (five years, six?) then, if Audi doesn't want to play ball, I suspect you are into serious legal costs to bring them to the table as the Small Claims Court is no longer available to you, so it may be irrelevant who is the correct legal entity to take on!

My position with Fiat was that the goods were of an unsatisfactory quality and not fit for purpose. I was not making any claim against a specific warranty (indeed, the three year vehicle warranty had already expired, so there was no warranty to argue about). You could use the same line in this situation - in which case it doesn't matter about the length or T&Cs of the paint warranty. For the Small Claims Court, though, you have to act against the supplying dealer (or, at least, that was what I was advised - it certainly worked).

Five years Scotland, six years England and Wales.

Small Claims Court isn't just about the SOGA, its a small claim against another person\company for some sort of breach. Say if it cost £1k to repair and put right then that would cost you £115 to take to court plus any solicitors fees.

Yes this would be against the SOGA and therefore as you say the retailer is the defendant and who you need to claim against. You are time bound to 6 years though regardless and you would have to prove unfit for purpose.

If you were over that time period, then you still have the extended paint warranty to go after, you could commission a report to say it has failed due to something that is covered by the warranty and present that in the small claims.

Any claim against the specific manufacturer's warranty terms and conditions would be against the manufacturer not the dealer. Any warranty remedial work would be paid for by the manufacturer not the dealer. Thus rust coming from underneath the paint to the outside surface would be covered by the warranty ( assuming no other paintwork had been made by a third party or mechanical damage)
