    hi guys could do with some advice from peeps who understand this legislation. my uncle seems to have fallen into a catch 22 situation, his insurers are telling him he must get rid of his car.?? .


    car is fit for use, unfortunately he is not as now too old & unwell to drive .
    he wants to keep his car so as his son can drive him to the weekly shop.
    the son is insured to drive the vehicle.

    dvla have taken back my uncles licence as now unfit to drive, why does this stop him owning a car?
    i guess if he cannot insure himself to drive it it contravenes the permanently taxed/sorn and insured legislation?


    if he can prove his son is insured to drive the vehicle , why are they forceing him to relinquish his possession when he has no intention of driveing it himself??.


    any thoughts would be welcome.
    VW golf mk3 1.9DL estate & it is a state

    its falling apart faster than i can fix it, an mot pass will be a bloody surprise

    Could the car just be registered with his son as keeper.

    car has to be sorn or taxed and insured. uncle can't drive so can't have insurance, so his son will be the main driver, so he takes a policy out on it, problem solved. makes no difference who it is registered to, just who the main driver is.
    Audi 80 tdi avant with 360,000 miles...

    Totally correct... For example if you have a car on a lease agreement the owner on the log book is the lease company (IE Audi UK / Mercedes Finance ETC. Your uncles son can get his own policy no issues the car will be covered legally... Just be careful to read the small print on the insurance as some will make "assumptions" that the policy holder is the registered owner and keeper... Most of them ask you this question though.
