    Hi All,

    Need some general advice from you all.

    On the 30th of March 2013 I hired a Lambo at a cost if £1200 for 2 days for my sisters wedding, during the first 12 hours in which I was driving some jealous idiots rear ended me damaging the rear diffuser. After that my friend (who arranged the hire) drove the car and had an accident in it around 6AM on the 31st of March, therefore was not drivable and I could not take my only sister to her wedding. He paid for his damages (£7,000) and I paid for my damages (£1,500). Should I ask him to pay me for the money I lost in daily rental? About £900.

    I have asked him several times, and he refused to believe he owes me that money. I have now taken action to take him to court, but I have no physical evidence except text messages from him and a bank transfer to the hire company. His reason for not paying is because I also damaged the car but was still drivable.

    Any advice much appreciated.

    you are both idiots for hiring a car like that for a special occasion, then messing around and crashing it. you paid for it, then let someone else drive it, now want money off him for not being able to drive it. was he insured ? presumably not if he had to pay for the repairs ?
    i dunno, i would bang both your heads together and make you drive a trabant for a month.

    He was insured and that was the excess. So what should I do? Am I in the wrong?

    no, you let him drive, you accept the risk. i think a judge would say the same. your choice, there is no correct answer.
    thats a heck of an excess.

    Hmmm I guess I should take that on the chin then. It's a lot of money to lose plus another £60 to file a claim with the court.

    That's the excess for a 22 year old on a lambo 😭

    nice car , must have been a proper hoot whilst it lasted .
    i would say take it on the chin. might be worth pursuing it , just not in my opinion.

    When I was going sleep that night all I could hear was the engine in my head! Also bear in my that this is a friend whom I've know for many years.

    So I'm really stuck on what to do. As I lost out £900 due to him having an accident with the car.

    Your 22 and they let you hire it????? they must have known that you were going to bin it and probably kill yourself......

    Put it down to experience and swallow that bitter pill, also i would like to know how a 22 year old can afford that kind of coin? i was lucky to have a Fiesta when i was that age.

    a situation like this makes proper friends even closer, and sorts out friends that arn't so good.
    a true friend would have immediately offered monies towards the hire cost, and sorted out another car for the wedding. refusing point blank just makes him the sort of friend you can do without. i have had many like this in the past. maybe court is the best place to settle it. as said , there is no correct answer, it is down to morals. we could take a vote, anything, but only a judge would give an opinion that counts.

    i wonder where a 22 year old gets that sort of money, and where a mate gets 7k to pay the excess, but then some people do live a different sort of lifestyle. maybe he has a well paid job or rich parents, none of my business though.
