Over revving Diesel engine

Hi i'm new to forums so here go'es. I have a 2001 Audi 1.9 TDI and the engine blew up on me which had only done 5000 miles. The insurance company claim that i over reved the engine by changing down from 4rd to 3th gear. I'm quite addament that after 24 years of driving that they do not know what they are talking about. Should there not be a rev limiter on all these engines as most of the new cars i have driven have these. dah1164.
